1. App Introduction
CASE WATCH is a digital application that allows users to consult and receive notifications regarding the procedural status of court cases, based on official information available to the public, issued by Tunisian courts and public bodies/institutions.
The application aims to facilitate access to public judicial information, in furtherance of transparency, legal information, and services for litigants and legal professionals.
2. Sources of Information
The data displayed through CASE WATCH:
- Is sourced exclusively from official and public judicial sources;
- Is publicly accessible online without requiring registration, identity verification, or restricted access;
- Is consulted without any circumvention or bypass of technical protection measures.
CASE WATCH operates as a technical tool for automated consultation and notifications, without any interference with the content of the data published by the competent authorities.
3. Intellectual Property and Databases
Pursuant to the Tunisian Intellectual Property Code, CASE WATCH:
- Does not make any total or substantial copying of protected databases;
- Does not carry out any mass, systematic extraction that could prejudice the rights of database producers;
- Provides the information solely for informational purposes, without alteration, modification, or reinterpretation of its content.
Any potential rights relating to such information remain the exclusive property of the relevant public administrations and institutions.
4. Personal Data
CASE WATCH complies with Law No. 63 of 2004 dated 27 July 2004 relating to the protection of personal data. For this purpose:
- The application does not collect, store, or process any sensitive personal data;
- It does not create any nominative/personal file, nor does it rely on any profiling, classification, or cross-referencing of data;
- Any identifying information displayed, if any, is limited to what has already been made public by the competent judicial authorities.
The data is used exclusively for accessing judicial information, without any commercial exploitation of the data itself.
5. Respect for Privacy
CASE WATCH refrains from any intrusive indexing, any display that could cause harm, or any use that may infringe privacy, reputation, or the rights of the persons concerned.
The application respects the principles of purpose limitation, proportionality, and neutrality.
6. Compliance with Decree-Law No. 54 of 2022
CASE WATCH is used in strict compliance with Decree-Law No. 54 of 2022 on combating crimes related to information and communication systems. Accordingly:
- The application does not create, publish, or promote any false, inaccurate, altered, or misleading content;
- It does not enable any infringement of public order, public security, or individuals' reputation;
- The data is displayed exactly as received from official sources, without comment, analysis, or legal characterization.
7. Neutrality and No Judicial/Legal Characterization
CASE WATCH is not:
- A media outlet, press service, or judicial publication platform;
- A tool to attribute criminal charges, presume guilt, or present non-final decisions as final;
- A substitute for court registries, official notifications/service, or official judicial communications.
The displayed information reflects the procedural status of cases as officially published on the date of consultation.
8. Paid Service and Free Access to Information
Direct access to judicial information is free of charge and available to all users.
Notification/alert services provided by the application are subject to a fee, which is strictly limited to the technical consideration for the service provided by CASE WATCH.
No payment is required for access to the information itself.
9. User Responsibility
The user undertakes to use CASE WATCH in accordance with applicable laws and regulations, in particular:
- Tunisian legislation on personal data protection;
- The Intellectual Property Code;
- Decree-Law No. 54 of 2022.
The user alone bears full responsibility for any abusive, improper, or unlawful use.
10. Limitation of Liability
CASE WATCH cannot be held liable for:
- Errors, omissions, or delays in updating data published by official sources;
- Subsequent changes introduced by the competent authorities;
- How users make use of the data consulted through the application.
11. Governing Law and Jurisdiction
These legal notices are governed by Tunisian law.
Jurisdiction for any dispute related to the use of CASE WATCH lies with the competent Tunisian courts.
